1. Introduction  

Welcome to Damascus Road Consulting, LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our services, including assessments, coaching, and consulting, provided both in-person and virtually (collectively, the "Services"). By engaging our Services, you agree to comply with and be bound by these Terms.

These Terms also apply to The Highest You© assessment, a digital product owned by our company. Please read these Terms carefully before using our Services. If you are under 18 years of age, or do not agree to these Terms, please do not use our Services.

 

2. Services 

We offer professional consulting, coaching, and assessment services aimed at improving personal and professional development. Our Services are provided either in person or through virtual platforms, depending on client preferences and availability. Please note these Services do not represent medical advice, and participation does not create a doctor-patient relationship between you and Dr. Adam Meadows. 

 

3. Client Responsibilities (for coaching & consulting services)  

  • Clients must provide accurate and complete information to allow us to effectively deliver our Services.
  • Clients agree to actively participate in scheduled sessions, complete assessments as required, and engage in any necessary follow-up work.
  • Clients are responsible for ensuring that they have the necessary technology and internet access for virtual sessions.

 

4. Payment Terms (for coaching & consulting services) 

  • Fees for Services will be outlined in a written agreement or invoice. Payment must be made in accordance with the payment schedule specified in such agreements.
  • We reserve the right to suspend Services if payment is not received on time.
  • All fees for Services received are non-refundable unless otherwise agreed upon in writing. Refunds will be provided for unused Services after the Company receives written notice of termination of the contract from the Client. 


5. Cancellations and Rescheduling (for coaching & consulting services) 

  • Clients must provide at least 24 hours’ notice to cancel or reschedule an appointment. Failure to do so may result in the full fee being charged.
  • Damascus Road Consulting, LLC reserves the right to reschedule services with notice due to unforeseen circumstances.

6. Purchase of Digital Content (for The Highest You© assessment)

We offer digital content for purchase on the Website. They are provided as described there. We reserve the right to change the descriptions and Products offered from time to time.

  • Our Products are licensed, not sold, to you. They remain our property. The intellectual property rights (including copyright) in the Products remain with us and/or our authors/licensors as applicable. Our products may include digital rights management information and technology, which you agree not to tamper with or remove, and which is intended to deter or prevent misuse of our intellectual property.
  • Our assessment reports are in the PDF format and require an up-to-date PDF reader to be used for their intended purpose.
  • At the time you place any order for which payment is required you must give authority for payment. We may take payment from you at any time between you placing the order and us providing the services or you requesting access to the digital content.
  • Your order is an offer to purchase from us. There will be no contract of any kind between you and us unless and until we actually take payment from you, at which point we will email you with confirmation of the contract and acceptance of your order. At any point up until then, we may decline to supply the digital content to you without giving any reason. If we take payment and subsequently fail to make the digital content available to you for any reason we will refund you in full.
  • Payments are made through the Website electronically. When you pay by credit or debit card you consent to us carrying out certain checks which include obtaining authorization from your card issuer to ensure you have adequate funds and for security reasons. This may involve validating your name, address and other personal information with your bank or credit reference agencies if necessary.
  • We may change our fees at any time by posting new fees on our Order page. You will not be entitled to a refund in relation to Products you have already downloaded or otherwise accessed.
  • All prices shown are in U.S. dollars ($USD), unless specified otherwise, and include sales tax, where applicable.
  • Where after purchasing or otherwise downloading our Products you ask us to supply a replacement, unless you have a statutory right for us to replace the Product, any replacement is at our discretion. In particular please note that our assessment reports are updated from time to time, so a replacement of a previous version may not be available.

7. Refunds and Cancellation Policy (for The Highest You© assessment)

If you are not happy with any digital content that you have purchased from the Website, we will offer you a refund within 30 days of purchase, subject to the provisions below.

By requesting a refund, you certify that you have deleted all copies of digital content downloaded from or otherwise accessed on the Website, or sent to you by other means.

Gift codes and custom orders are non-refundable and non-exchangeable.

In order to obtain a refund, you must warrant to us that you have (i) not shared any copies of the relevant digital content with any other person and (ii) deleted or destroyed all copies of these materials that you have in your possession.

We reserve the right to refuse a refund if:

  • you placed an order after having requested a refund in the past;
  • your payment is linked to chargeback or dispute attempts;
  • you provide intentionally misleading information, e.g. reporting the payment as fraudulent despite having a completed assessment and order confirmation for the report.


8. Confidentiality 

We respect the confidentiality of all client information and will not disclose any personal or business information unless required by law or with the client’s consent.

Clients acknowledge that electronic communication, including virtual sessions, may not be entirely secure, and accept any associated risks.

 

9. Disclaimer of Warranties  

Our Services are provided on an “as is” basis. We make no warranties, express or implied, regarding the results or outcomes of the Services provided.

We do not guarantee that participation in coaching, consulting, or assessments will result in specific business or personal outcomes.

 

10. Limitation of Liability 

To the fullest extent permitted by law, Damascus Road Consulting, LLC shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our Services.

In no event shall our total liability exceed the amount paid by the client for the specific Service at issue.

 

11. Termination

Either party may terminate the Services at any time with written notice. If Services are terminated by the client, any fees paid for Services received are non-refundable unless otherwise agreed upon.

We reserve the right to terminate the Services if the client breaches these Terms or engages in conduct detrimental to our business or reputation.

 

12. Intellectual Property 

All materials, assessments, tools, and resources provided during the course of our Services are the intellectual property of Damascus Road Consulting, LLC and may not be reproduced, distributed, or used without prior written consent.

 

13. Governing Law 

These Terms shall be governed and construed in accordance with the laws of the United States of America. Any disputes arising from these Terms or the Services will be resolved in the jurisdiction of the state of Georgia, USA, unless otherwise specified by US federal laws.

 

14. Amendments 

We may update or modify these Terms from time to time. Any changes will be effective upon posting on our website or providing you with notice through other means.
